This information has been provided to help you understand everything you need to know regarding the way Caviar Careers collects your personal data from you.

Our services help to connect employees to employers, and the information we collect from you is used for that purpose.

We here at Caviar Careers take protecting your data very seriously and we strongly advise you to get to know our practices before engaging us. If at any point there is any misunderstanding or confusion, or if you simply want to ask us any questions, please feel free to contact us.

Caviar Careers is committed to protecting and respecting your privacy. By visiting https://caviarcareers.com/ (“our Website”) or using our SaaS online recruitment software platform (the “Service”) you are accepting and consenting to the practices described in this policy.

Governing Law and Regulation  

If you are a citizen or resident of Australia, New Zealand or any other country the Privacy Act 1988 and the Australian Privacy Principles apply. The Australian Privacy Principles are the cornerstone of the privacy protection framework in the Privacy Act 1988. They apply to any organization or agency the Privacy Act covers.  

There are 13 Australian Privacy Principles, which govern standards, rights and obligations around the following:-  

  • The collection, use and disclosure of personal information;
  • An organization or agency’s governance and accountability;
  • Integrity and correction of personal information; and
  • The rights of individuals to access their personal information.

We acknowledge that a breach of any Australian Privacy Principle is an “interference with the privacy of an individual” and can lead to regulatory action and penalties.

If you are a resident of the European Union (“EU”) or the United Kingdom (“UK”), the General Data Protection Regulation (EU) or Data Protection Act (“GDPR”) apply to your personal information.

For the purposes of the GDPR, the Data Controller is:-

  • in the instance where, for the purpose of providing our services to you or the organization you are a part of, your personal data is provided to or collected by us, the data controller is Caviar Careers with registered office address at Ross Spranklin & Co Chartered Accountant, 11 / 2012 Logan Rd, Upper Mt Gravatt QLD 4122; and
  • in the instance where your personal data is provided to, or collected by, any licensee of our services, including without limitation our online recruitment software system, then the data controller is the licensee on whose behalf we may process such personal data.

For the purposes of the GDPR, the Data Processor is:-

  • JobAdder

You acknowledge and agree that the Personal Information may be transferred or stored outside the EEA or the country where you and any Invited Users are located in order to carry out the Service and Caviar Careers’ other obligations under this Agreement;

You shall ensure that you are entitled to transfer the relevant Personal Information to Caviar Careers so that Caviar Careers’ and JobAdder may lawfully use, process and transfer the Personal Information in accordance with this policy on your behalf;

You shall ensure that the relevant third parties have been informed of, and have given their consent to, such use, processing, and transfer as required by all applicable data protection legislation;

each party shall take appropriate technical and organisational measures against unauthorised or unlawful processing of the Personal Information or its accidental loss, destruction or damage.

Overseas disclosure

The data that we collect from you may be transferred to, and stored at, a destination outside Australia, New Zealand, UK, or the European Economic Area (“EEA”), that does not have a similar standard of protection to Australia, New Zealand, UK or the EEA (as applicable). It may also be processed by staff members operating outside these areas who work for us or one of our suppliers.

These staff members may be engaged in, among other things, the fulfilment of any order, the processing of payment details and the provisions of support services. This may include the transfer or disclosure of your information to other jurisdictions including but not limited to the United States and Canada.

We further note that Caviar Careers is committed to the protection of children’s online privacy. Our policy is not aimed at children under 13 years of age, and we will not intentionally collect data from those under 13 years of age.

Data we collect

Information we collect about you 

When you visit our website, we may automatically collect the following information:

  • Technical information, including but not limited to the IP address used to connect your computer, tablet, mobile or other device to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system, and platform; and
  • Information about your visit, which can include, the page response time, download errors, how long you visit our website, page interaction information (this includes scrolling, clicks, etc.) and any phone number used to call our customer service line.

Information you provide to us using the “Contact Us” Form

When using the “Contact Us” form, we collect your email address, name, subject and message that you provide on the form and store it in a database.

The contact details retained in our database are used to get back in contact with you, using the email address you have provided. Additionally, we may use this information to help classify and filter other messages we receive.

In addition to the information you have provided, we keep an encrypted hash of your IP address which is used to determine if you have previously sent messages to us and may also be used for filtering data. We do not disclose any information received via the contact us form to any third parties for email marketing or advertising purposes.

We reserve the right to contact you later using the email address or any additional contact details you provide in the message.

Information you provide to us when submitting a Job Applications Form

As a part of our standard business practices, we may transfer the information you submit to us when applying for a job to a third-party Software-as-a-Service (“SaaS”) which is held on servers operated on their behalf by their own hosting providers.

We may send your information to potential employers, authorised recruitment technology providers used in the recruitment process, or other agencies working on behalf of our clients for the purpose of assessing your suitability for employment and managing the recruitment process.

We may match your job application to future jobs and contact you if you meet the criteria for them.

By applying for a job, you agree that the submitted information may be used for the above purposes.

We do not use any information you have submitted for third party targeted advertising.

Security of Information

All information you provide to us is stored on secured servers. Caviar Careers may transfer the information you submit to us when applying for a job to a third-party SaaS.

Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access however, we cannot guarantee the security of such information. To the fullest extent permitted by the law, we disclaim all liability and responsibility for any damages you may suffer due to any loss, unauthorized access, misuse or alterations of any information you submit to the website or our Service.

Who will Caviar Careers share your Personal Data with?

To achieve the above stated purposes regarding your personal data, we may have to share your personal data with certain third parties. When sharing your information, we shall make all reasonable efforts to ensure that any third party that we share your personal data with is also compliant with data protection law.

The kinds of third parties we may share your personal data with include the following: -

  • Client’s HR personnel and other staff where the candidate application is being submitted for consideration.
  • Candidate’s Referees for the purpose of supplying a reference
  • Embassy’s processing visa documents
  • External Agents processing applications, medical reports, visa’s and government processes required for international working abroad.
  • Medical Clinic’s arranging for a medical test
  • Travel Agents arranging travel
  • LinkedIn Recruiter for sourcing candidates and presenting job opportunities, synchronisation of candidate information between JobAdder and LinkedIn Recruiter for recruitment purposes.
  • Recruitment Technology Providers

We use third-party recruitment technology providers to assist us in sourcing, managing and presenting candidates for employment opportunities. These providers may include recruitment software platforms, applicant tracking systems and professional recruitment networks such as LinkedIn Recruiter.

Where appropriate, candidate information may be securely synchronised between these systems for legitimate recruitment purposes, including managing applications, communicating with candidates, tracking recruitment activity, and presenting suitable candidates to employers. We only share information that is necessary for recruitment purposes and require our technology providers to maintain appropriate privacy and security standards.

Caviar Careers will use our reasonable endeavours to ensure that all third parties that handle our customers data will also be compliant with the GDPR.

Information you give to us

We will use the information you provide for the following:-  

  • Assessing the job application
  • Processing the application as a candidate for a position
  • Processing the candidate for onboarding
  • Retaining for matching to future open job positions that may be of interest

Information we collect from you

How long will Caviar Careers keep your Personal Data?

We keep your personal data only for as long as required to achieve the purpose for which it was collected, in line with our privacy policies.

The following criteria are what determine the period for which we will keep your personal data:

  • Until our company is no longer required to comply with regulatory requirements or financial obligations;
  • Until our company is no longer required to do so by any law we are governed by;
  • Until all purposes for which the data was originally gathered have become irrelevant or obsolete; and
  • Unit it has been requested by our customers that we no longer process the data and that it be erased from our systems.

Additionally, Caviar Careers will only keep your personal data for as long as is reasonably necessary for the purpose that it has been processed and considering any legal requirements under the GDPR, or any other applicable laws if you are located in the UK, and under the Australian Privacy Laws.

How we manage sensitive personal data

The GDPR defines certain information as “sensitive”. This can include but is not limited to racial or ethical origin, political opinions, religious beliefs, trade or union membership, physical or mental health, sexual life, criminal proceedings and offences. If we deal with any sensitive personal data, we will only use this information to provide the service you require, and we will ask for your explicit consent. As our customer, there may be certain scenarios where you give us this sensitive information. We may share it with our affiliates and our subcontractors to keep your records up to date and safe.

Your Rights

There are several rights that are provided to you immediately upon you providing our company with your personal details; some of these are mentioned above in our privacy policy. However, we’d like you to know that at Caviar Careers we take your rights seriously and we will always conduct ourselves in a professional way that is considerate of our responsibility to serve your legal rights.

You as our customer have the right to ask us not to process any of your personal information for marketing purposes. You can exercise your right to prevent such processing by checking certain boxes on the pages we use to collect your data or by contacting us at any time on our support email admin@caviarcareers.com.

You also have the option to not provide any information. However, if you do decide to not provide us with your information, we may not be able to provide you with certain services or be able to fully assist you.

The GDPR and Australian Privacy Laws give you the right to access information held about you and to request that it is correct if any of your details held are incorrect. Your right of access can be exercised in accordance with the GDPR or Australian Policy Laws, as applicable.

Correction Policy:

If you find that personal information that we hold about you is inaccurate, out of date, inadequate, irrelevant, or misleading, you can ask us to correct it by contacting us.

We will take such steps as are reasonable in the circumstances to correct that information to ensure that, having regard to the purpose for which it is held, the information is accurate, up to date, complete, relevant and not misleading.

If we have disclosed personal information about you that is inaccurate, out of date, inadequate, irrelevant or misleading, you can ask us to notify the third parties to whom we made the disclosure. We will then take all the necessary and reasonable steps (if any) in the circumstances to give that notification unless it is impracticable or unlawful to do so. We will endeavor to correct any information within thirty (30) days.

The Right to Removal

Otherwise known as the “right to be forgotten”, this gives you the right to request your personal data be deleted. This is not an absolute right. If you were to request that we erase your personal data, we would erase as much of the data as possible but may have to retain some information if it is necessary. When we have received a request for personal data to be erased, if it is necessary for us to retain some of that information, we shall ensure that the remaining data is used only when and where it is absolutely necessary.

Privacy Complaints

If at any point you believe that we have breached any applicable privacy laws, or if you wish to make a complaint regarding the way we have handled your personal data, we recommend you contact us via email admin@caviarcareers.com. Once we have received your email, we will respond within thirty (30) days from receipt of your complaint.

Marketing

We may from time to time provide you with an “opt in” or “opt out” mechanism, subject to the requirements of the Australian privacy laws or the GDPR. An “opt in” mechanism will provide you with the opportunity to positively indicate that you would like for our company to provide you with further communications and we will not send anything unless you have “opted-in”. An “opt out” mechanism will provide you with the opportunity to indicate that you do not want our company to send you further communications, and if you do decide to “opt out” we will remove you from our list.

Opting- in and opting-out will be up to you and, in addition, if you do not want us to use your personal data for any particular purpose or for us to disclosure it to a third party, then we recommend you “opt out” by contacting us. Please note, that if you decide to opt out, you may not be able to participate in certain activities on our website/service.
